                              摘    要: 中国自古被誉为礼仪之邦,传统儒家思想更是将“礼”奉为圭臬。“礼治”是儒家思想中的精髓,虽然其中亦有繁文缛节、等级观念等消极因素束缚甚至阻碍了社会进步,但瑕不掩瑜,其中精华仍可为今天所发掘和借鉴。把握礼治在当代社会中的积极功能、助力当代中国政治文化建设的实现路径、参与当代政治文化建设的启示与检省等几个方面,有助于探索礼治思想的基本精神及当代价值。

                              一、“礼治”思想的基本精神及其在当代政治文化建设中的功能

                              (一)“礼治”思想的基本精神

                              “礼”是儒家思想中的一个重要概念,也是对人的品行及国家制度优劣的评价标准。孔子看到季氏用“八佾舞于庭”[1]25(“八佾”即六十四人,是周天子专用的祭祀乐舞,季氏是鲁国大夫,卿大夫只能用“四佾”),便忿恨至极,说“是可忍,孰不可忍也”[1]25。可见,在古代,“无礼”是对一个人道德品行最极端最贬低的评价。《说文解字》中对“礼”的释义是:“履也,所以事神致福也。”“礼”最初是祭祀鬼神,求得幸福的仪式,之后又囊括了很多不成文的习俗和传统,后来才在此基础上上升为社会行为规范,有了具体条文规定。早期的礼有着十分广泛的内容,除了个人层面的冠礼及笄礼、婚丧嫁娶,社会层面的习俗、道德、行为规范、社会关系外,还包括国家治理中的经济政治制度,甚至包括了刑罚、辩讼、治军等与“法”息息相关的治理手段“道德仁义,非礼不成,教训正俗,非礼不备。分争辨讼,非礼不决。君臣上下父子兄弟,非礼不定。宦学事师,非礼不亲。班朝治军,莅官行法,非礼威严不行。祷祠祭祀,供给鬼神,非礼不诚不庄。是以恭敬撙节退让以明礼。”[2]3。孔子更是主张“礼”应该是人们的一切言行应该尊奉的标准,做到“非礼勿视,非礼勿听,非礼勿言,非礼勿动”[1]185。
